PINKY UP TRAVEL Mobile Application Privacy Policy

Effective as of August 1st, 2021

By visiting and/or using our App, you are agreeing to the terms of this privacy policy (the “Privacy Policy” or “Policy”) and our terms of service (“Terms of Service”).

This Privacy Policy applies to the Pinky Up Travel mobile application (the “App” or “Service”), owned and operated by Pinky Up Travel, LLC (“Pinky Up Travel,” “we,” “us,” or “our”). 

We have created this Privacy Policy to inform you of the information the App collects, how we use that information, and who we will share that information with, if at all. This Privacy Policy does not address the privacy practices of any third parties that we do not own or control. We encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions. 

By visiting and/or using our App, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Service.

What Information Do We Collect and Process?

To provide our Service as defined in our Terms of Service, we must collect and process information. This section outlines the types of information that we collect and process. You authorize us to collect and process such information.

We do not collect any personal information (“Personal Information”) from you unless you voluntarily provide it to us either directly or through a third party via email, phone, use of our App or website, or other means. In this Policy, Personal Information refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is aggregated or information that cannot be reasonably linked to you. Select Personal Information that we collect from you will be reflected on the App in your trip itinerary and other travel documents. 

  1. the names of the other travelers in your party, 
  2. location destinations, 
  3. travel dates, 
  4. hotel accommodation details, 
  5. flight information, and 
  6. tour vouchers. 

How Information is Used. 

We will use the Information we collect:

  1. to provide our Service,
  2. to contact you,
  3. for marketing purposes,
  4. for general research and analysis purposes,
  5. to protect our or others’ rights, property, or safety,
  6. to comply with any legal or regulatory obligations, and 
  7. for other legitimate business interests.

With Whom We Share Your Information.

  1. when required by law, court order, or other government or law enforcement authority or regulatory agency; or
  2. whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of us or others, including you.

How We Protect Your Information. 

We use a variety of technical, administrative, and organizational security measures, including encryption and authentication tools in certain circumstances, to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is completely secure. We cannot guarantee the security of our databases or the databases of the third parties with which we may share your information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mails sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail. Pinky Up Travel cannot control whether you, your trip organizer, or the travelers in your party share any account credentials with others or otherwise disseminate the information available on your account. We encourage you to take reasonable steps to protect your personal information against unauthorized disclosure or misuse.

How Long Your Information Will Be Kept. 

We will keep your information on the App for as long as you as long as you keep your account, so that you can revisit past itineraries and your journal after the end of your trip. You may request that we delete your account at any point. In some cases, we may need to keep certain information longer to for legal reasons. 

Accessing and Modifying Your Information. 

If you have provided us with any Personal Information, you may access, remove, review, and/or make changes to the extent permitted by law by contacting us as set forth below at the end of this Privacy Policy. We will need to verify your identity and ensure your right to access your Personal Information. In certain situations, the law may permit us to deny your request. 

App Stores; External Websites. 

Your app store (e.g., iTunes or Google Play) may collect certain information in connection with your use of the App. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies.

The App may contain links to third-party websites. We have no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.

Children Under the Age of 13. 

The App is not targeted at children under the age of 13 or at a general audience that includes children. We adhere to the Children’s Online Privacy Protection Act (COPPA) and will not knowingly collect Personal Information from any child under the age of 13 without the consent of the child's parent or guardian. If you believe that a child under the age of 13 has provided us with Personal Information in violation of this Privacy Policy, please contact us. If we learn that a child under the age of 13 provided us with Personal Information without our receipt of prior parental consent, we will notify the child’s parents or guardians.

We recognize that some clients may want their children to have access to the App. Therefore, clients may request that we create an account for a child under the age of 13 by emailing us at contact@pinkyuptravel.com with “Child Under the Age of 13” in the subject line. California Residents. 

The California Consumer Privacy Act and California Privacy Rights Act afford California residents the following consumer rights. You may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. To protect your information, we will need to verify your identity before processing your request.

  1. the categories of Personal Information we have collected from you, 
  2. the categories of sources from which we collected the Personal Information information, 
  3. the business or commercial purpose for collecting the Personal Information,
  4. the categories of third parties with whom we share Personal Information, 
  5. the categories of Personal Information that we have disclosed about you for a business purpose within the last twelve (12) months, and 
  6. the specific pieces of personal information.

Important Notices to Non-U.S. Residents. 

The App and its servers are operated in the United States. If you are located outside of the United States, please be aware that your Personal Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to use our App, you hereby irrevocably and unconditionally consent to such transfer, processing, and use in the United States and elsewhere.

Changes to This Privacy Policy. 

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the App. We will notify you of any changes by email prior to their effective date. By accessing the App after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. CHILDREN’S PRIVACY DISCLOSURE FOR THE PINKY UP TRAVEL MOBILE APPLICATION

This disclosure and The Pinky Up Travel Mobile Application Privacy Policy describe how we handle personal information we collect from children under the age of 13 ("child" or "children"). Our Pinky Up Travel mobile application (the “App” or “Pinky Up Travel App”) is not targeted at children under the age of 13; however, we recognize that some clients may want their children to have access to the App. 

Under the Children’s Online Privacy Protection Act (COPPA), your consent is required for the collection, use, or disclosure of any personal information from your child. Therefore, you must provide consent to the collection, use, and disclosure of personal information from your child as described in the Pinky Up Travel Mobile Application Privacy Policy and this Direct Notice before we can create an account for your child. We will not create an account for your child or collect, use or disclose any personal information from children under 13 years of age without parental consent. 

This notice describes our practices of collecting, using, and disclosing personal information from children under the age of 13. Instructions for giving consent are provided below. If we do not receive your consent within a reasonable time, Pinky Up Travel will delete your online contact information from our records.

Information We Collect.

The Pinky Up Travel Mobile Application Privacy Policy, which is incorporated herein by reference, details the types of personal information that we collect and/or process from users. COPPA applies to personal information collected online from children, including personal information about themselves, their parents, friends, or other persons. It does not apply to information we collect from you about your child. Should you provide consent, Pinky Up Travel may collect the following information directly from your child. 

Information Third Parties May Collect from Your Child.

This disclosure does not apply to the practices of any third-party services (including apps, skills, and websites) that may be accessed through our App. Before using any third-party service, you should review the applicable terms and policies to determine their appropriateness for your child, including the service’s data collection and use practices.

Application Programming Interfaces (APIs)

Our App includes a map that is operated by a third-party service provider, Mapbox, Inc. (“Mapbox”), and integrated into our App via an application programming interface (API). By using the map, Mapbox may collect the following personal information from your child, so we encourage you to read our service provider’s privacy policy prior to giving us consent to create an account for your child. Pinky Up Travel does not collect or receive this information.  

Mapbox may automatically collect certain technical information. This technical information includes (a) your IP address, (b) your device and browser information, (c) your operating system, (d) the content of the request, (e) the date and time of the request, (f) limited location and usage data, and (g) randomly generated ID. Certain features and functionalities of the map require access to your child’s specific geological information. Your child may decline access to the geolocational information, in which case we will not be able to provide certain features or functionalities. In many cases, your child’s mobile device platform will provide additional tools to allow you to control when your child’s device collects or shares particular categories of personal data.

External Websites; App Stores

The App may contain links to third-party websites. We have no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.

Your app store (e.g., iTunes or Google Play) may collect certain information in connection with your use of the App. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies.

How Information is Used.

We will use the Information we collect:

  1. to provide our Service,
  2. to contact you,
  3. for marketing purposes,
  4. for general research and analysis purposes,
  5. to protect our or others’ rights, property, or safety,
  6. to comply with any legal or regulatory obligations, and  
  7. for other legitimate business interests.

With Whom We Share the Information That We Collect Directly from Your Child.

Your Consent and Parental Controls. 

You choose whether to give us permission to collect Child Personal Information from your child and can revoke it any time. Clients may request that we create an account for a child under the age of 13 by emailing us at contact@pinkyuptravel.com with “Child Under the Age of 13” in the subject line. We will send you a direct notice with more information as well as a consent form for you to sign. 

Upon receipt of your signed consent, we will create an account for your child, which you can access at any time by using your child’s username and password to log in. You will be responsible for (i) deciding what content, if any, your child may post on the App’s Journal feature; (ii) choosing whether to grant access to geolocational tracking; and (iii) actively monitoring your child’s content. You agree that you will only allow your child to post any personal information with your consent. 

You can contact us at contact@pinkyuptravel.com to request access to, change, or delete your child’s personal information or to revoke your consent. A valid request to delete personal information will be accommodated within a reasonable time. At any time, you can refuse to permit us to collect further personal information from your children in association with a particular account and can request that we delete from our records the personal information we have collected in connection with that account. 

In the event we discover we have collected information from a child in a manner inconsistent with COPPA’s requirements, we will either delete the information or immediately seek the parent’s consent for that collection.
